Art. 1 Purpose

The present terms and conditions regulate the use of the website hosted at www.simply-jet.ch as well as the domain names redirecting to it including but not limited to: www.simply-jet.fr, www.simply-jet.it,www.simply-jet.de, www.simply-jet.co.uk, www.simply-jet.com, www.simply-jet.us, www.simplyjet.ch, www.simplyjet.fr, www.simplyjet.it, www.simplyjet.de and www.simplyjet.co.uk.

The website owner and editor is the company Simply Jet Ltd, VAT number CH-358.477.326, with headquarters at Rue du Maupas 2, 1004 Lausanne, Switzerland.

The present terms and conditions apply to the entirety of the website, for all the services offered, and might be completed by additional terms and conditions that are specific to said services.

Art. 2 Definitions

“User”: a user of the website, a customer of Simply Jet.
“Simply Jet”: Simply Jet Ltd.
“Flight Request”: an inquiry about pricing a User can make on the website.
“Empty Leg”: a noncommittal price indication for a flight originally flying without passengers.
“Operator”: the legal entity holding an aircraft operator certificate that owns and operates aircraft.
“Aircraft Charter Service”: the core service offered by Simply Jet, acting as an intermediary, on behalf of a User.
“Aircraft Charter Service Contract”: the legal document that the customer signs to confirm an Aircraft Charter Service.
“Website”: www.simply-jet.ch and the websites redirecting to it.
“T&Cs”: the Website's terms and conditions.

Art. 3 Introduction

Simply Jet uses the Website to promote its Aircraft Charter Service. It only acts as an intermediary between the User and the Operator and as such does not operate, maintain, own or charter aircrafts.

Art. 4 Acceptance of the T&Cs

By navigating on this Website you agree to the T&Cs and agree to access it only to make a legitimate Flight Request, enter into a commercial relation with Simply Jet or to browse our educational content.

Art. 5 Intellectual Property

All the content on the Website is Simply Jet's intellectual property and may not be, in any circumstances, copied, reproduced, modified or altered in any way before asking for prior consent to the CEO of the company, Yann-Guillaume Jaccard, at the following email address: yann.jaccard@simply-jet.ch.

Any infraction to this article or any other part of the T&Cs will systematically lead Simply Jet to take the case in front of the relevant court.

Art. 5 Content

Simply Jet endeavours to publish only accurate content on the Website. However, it cannot guarantee the veracity of all the information contained on the Website. As such, Simply Jet cannot be held responsible for any mistakes made on the Website and potential direct or indirect repercussions due to the utilisation of such incorrect information.

Art.6 Contractual engagement

No action on the website is contractually binding for either parties until the User signs physically or electronically on the Website the Aircraft Charter Service Contract.

Art.7 Payment

No monetary transactions take place on the Website and credit card details will never be asked on the Website. Payment for the Aircraft Charter Service is made by bank transfer according to instructions given to the User once he has signed the Aircraft Charter Service Contract.

Art. 8 Empty Legs

The prices indicated on the Empty Legs are indicative only and not a contractual offer, as there are by nature constantly changing. The final availability and price can only be confirmed once the User has reached out to Simply Jet and the Operator in charge of said Empty Leg has given confirmation.

Art 9. Jurisdiction

These T&Cs shall be governed by the laws of Switzerland as is in force at the time. Any dispute arising out of or in connection with the T&Cs shall be submitted to the exclusive jurisdiction of the courts of Lausanne, Switzerland. An appeal before the Swiss Supreme Court is reserved.
